Unit I-4, Gentle Winds Resort, St. Croix, USVI (Caribbean Breeze)

plus tax, payable as follows:
(1/2 the weekly rental) to be paid within five (5) days of verbal reservation
by D. Smith using MC # XXXX XXXX XXXX 7377 exp. 11/09 on 7/15/08.
Our receipt of your deposit constitutes your acceptance of this
contract in its entirety

4. SECURITY: A
deposit in the amount of $500.00 is payable at the time final payment
is made (credit card approval, cash or check) and will be returned
by the lessor within four weeks after lease expiration less any amount
deducted for damage and/or long distance telephone charges. Lessee will
also be responsible for any damages exceeding the $500.00 security deposit.
The lessor will provide, water, electric, gas, trash removal, and local
telephone usage. Lessee is responsible for all long distance calls made
during tenancy. (Note: Lessor is not responsible for any power, telephone,
internet and/or cable TV outages caused by the utility companies.)
No Pets, NO SMOKING OF ANY KIND INSIDE THE VILLA. Violation
of these restrictions may result in additional cleaning fees.
Caribbean Breeze - One King bed, two twin beds, and one queen sleeper
sofa. If needed, a crib and highchair is also included. Villa Dawn -
Two king beds, one queen bed and one queen sleeper sofa on main level.
Lower level suite has a separate entrance and has two twin beds (that
can be made up as a king) and a daybed and trundle. If needed, two roll-away
beds and two cribs are also included.
8. MAXIMUM NUMBER
OF OCCUPANTS: The house is to be occupied by no more than _____(_)
persons at a maximum, unless authorized in advance by the LESSOR.
VIOLATION OF THE MAXIMUM
OCCUPANCY PROVISION WILL RESULT IN ADDITIONAL CHARGES TO THE LESSEE.
9. LESSEE assures the
LESSOR that the tenants will observe all conditions and terms of this
lease as to maintaining the premises in good order and appearance and
will conduct themselves in a manner inoffensive to neighbors.
10. LESSEE assures the
LESSOR that any tenant who violates any of the terms of this Lease shall
be immediately denied occupancy and shall remedy any damages or other
expenses which are caused by the tenant and/or the tenant's guest(s).
11. LESSEE and/or their
guests shall not disturb, annoy, endanger, or inconvenience neighbors,
nor use the premises for any unlawful purposes, nor violate any law
or ordinance, nor commit waste or nuisance on or about the premises.
12. LESSEE agrees that
during the term of this lease and such further time as he/she occupies
the premises, he/she will keep the leased premises clean and free of
trash, garbage, and other waste; and all pipes, wires, glass, plumbing
and other equipment and fixtures in the same condition as at the beginning
of, or may put in during the term of the lease, reasonable wear and
tear and damage by unavoidable fire and casualty only exception.
13. LESSEE has been advised
that Villa Dawn and Caribbean Breeze have second story decks, and non-gated
pool areas and LESSEE agrees to advise all residents and guests of such
hazards and to take all reasonable precautions in use of such. LESSEE
agrees to indemnify and save LESSOR and its affiliates harmless from
and against any and all claims, actions and suits and from and against
any and all liabilities, losses or damages and expenses of every nature
and characteristic, in each case including, without limitation, the
reasonable fees and disbursements of counsel to owner, arising out of
LESSEE"S occupancy of the premises, including, without limitation, those
arising out of carelessness, negligence or improper conduct which may
result in harm or injury to LESSEE.
14. LESSEE agrees that
he/she shall not paint or make alterations to the property, without
the LESSOR'S written consent.
15. Upon not less than
24 hours notice, LESSEE shall make available to LESSOR or his agent
for the premises of entering to make necessary or convenient repairs.
In an emergency, LESSOR or his agent may enter the premises at any time
without securing prior permission from LESSEE.
16. LESSEE may not let,
sublet or assign this lease for all or any part of the premises without
prior consent of the LESSOR.
17. If LESSEE abandons
or vacates the premises, LESSOR may at his option terminate this lease,
enter the premises, and remove all property.
18. In the event that
any action shall be commenced by either party arising out of, or concerning
this lease or any right or obligation derived therefrom, the prevailing
party shall be entitled to receive attorney's fees as fixed by the Court
in addition to all relief at law or equity.
19. Either party may
terminate this lease in the event of a violation of early provision
of this lease by the other party in the manner and as provided by law.
20. LESSEE assumes full
responsibility for fulfilling the terms of the lease for the period
stated and assures the LESSOR full recourse for the payment of any amount
outstanding from the total amount due in accord with the terms as stated
above including any outstanding or unpaid charges that are the responsibility
of the LESSEE.
CANCELLATIONS: In the event
of cancellation of this contract, refunds will be made only to the
extent that a tenant can be found to occupy the vacated time
reserved under this contract, will be paid at the recovered rate,
less a 10% cancellation fee. No refunds will be made within 60 days
of the reserved dates stated in this contract, however, if a tenant
can be found to occupy the vacated time reserved by the LESSEE,
LESSOR will allow LESSEE to select a future available time period in
a comparable rate/season category, in lieu of a refund. You may want to consider
trip cancellation insurance.
Keys to the Villa/Condo
must be returned immediately upon return from your vacation. There will
be a $100 fee for lost keys or keys not returned.
23. LATE CHECK-OUT:
specifically agrees that in the event the villa is vacated later than
11 a.m. on the date indicated, LESSEE shall pay a late fee of $100 for
each hour or fraction thereof that they continue to occupy the premises,
unless prior approval is granted by LESSOR.
